TERMS AND CONDITIONS OF EMPLOYMENT

The Time Off for Public Duties Order 1995

The Secretary of State, in exercise of the powers conferred on him by sections 29(5)(a) and 154 of the Employment Protection (Consolidation) Act 1978(1), hereby makes the following Order:-

Citation and commencement

1. This Order may be cited as the Time Off for Public Duties Order 1995 and shall come into force on 1st April 1995.

Addition of members of police authorities

2. Section 29(1) of the Employment Protection (Consolidation) Act 1978 shall be modified by inserting the following paragraph after paragraph (bb)-

"(bc)a member of a police authority appointed under Schedule 1B to the Police Act 1964(2);"

Explanatory Note

(This Note is not part of the Order)

Section 29 of the Employment Protection (Consolidation) Act 1978 requires an employer to allow time off during working hours, subject to the provisions of the section, to an employee of his who is a justice of the peace, member of a local authority or member of certain other bodies specified in subsection (1) of the section.

This Order modifies section 29(1) by adding members of police authorities established on the coming into force of certain provisions of the Police and Magistrates' Courts Act 1994 to the list of bodies whose members are covered by the section.
