The Secretary of State, after consultation with the Council of the Isles of Scilly, in exercise of the powers conferred on him by sections 117(2) and (3) of the Environment Act 1995(1), hereby makes the following Order:
1. This Order may be cited as the Environment Act 1995 (Isles of Scilly) Order 1996 and shall come into force on 1st May 1996.
2.-(1) The Environment Agency shall carry out in the Isles of Scilly the functions falling to be carried out in relation to other parts of England and Wales by that Agency by virtue of section 2(1)(d), (e), (f), (g) and (h) and (2) of the Environment Act 1995 (transfer of functions to the Agency), with the exception of the functions specified in section 2(2)(b) and (e) of that Act.
(2) Chapters I and III of Part I, sections 108 to 115 and 119 to 125, of the Environment Act 1995 shall apply in relation to the Isles of Scilly in so far as they relate to the functions conferred on the Environment Agency by virtue of paragraph (1) above.
3. Sections 98 and 99 of the Environment Act 1995 (grants for purposes conducive to conservation etc) shall apply in relation to the Isles of Scilly.

Article 2 of this Order gives the Environment Agency, with effect from 1st May 1996, certain functions in the Isles of Scilly which it has in other parts of England and Wales. The functions specified in Article 2 are those discharged before that date by Her Majesty's Inspectorate of Pollution. They concern integrated pollution control, radioactive substances and related matters, and include related functions of the Secretary of State.
Article 3 applies in the Isles of Scilly from the same date sections 98 and 99 of that Act. This gives the Minister of Agriculture, Fisheries and Food powers in the Isles of Scilly to make provision by regulations for grants for purposes conducive to conservation, and extends to the Isles of Scilly the Minister's powers, following consultation, to make and modify subordinate legislation specified in section 99.
