The Secretary of State, in exercise of the powers conferred by section 21 of the Clean Air Act 1993(1), being satisfied that the classes of fireplace described in the Schedule hereto can be used for burning fuel other than authorised fuels without producing any smoke or a substantial quantity of smoke, hereby makes the following Order:
1. This Order may be cited as the Smoke Control Areas (Exempted Fireplaces) Order 1996 and shall come into force on 15th May 1996.
2. The classes of fireplace described in the Schedule shall, upon the conditions there specified, be exempted from the provisions of section 20 of the Clean Air Act 1993 (which prohibits smoke emissions in smoke control areas).
3. In the Schedule to the Smoke Control Areas (Exempted Fireplaces) Order 1991(2), in the entry relating to the Talbott's Warm Air Heaters Down Firing range models D250, D500 and D700, in Condition 2, for the words "chipboard or plastic coated chipboard" there shall be substituted "chipboard, plastic coated chipboard or cardboard".

The fireplaces shall be installed, maintained and operated in accordance with the manufacturer's instructions dated October 1995 bearing the following reference:- (a);model 500G: "500G"; (b)model 700G:"700G". 2 No fuel shall be used other than wood. |
The Farm 2000 boiler models BB154, BB154A and BB154/2 (when used with the Farm 2000 conversion kit BB154/2Vcx), manufactured by Farm 2000 Limited. | 1. The boilers shall be installed in accordance with the manufacturer's instructions dated May 1994 bearing the reference "BB154/2VC", and maintained and operated in accordance with the manufacturer's instructions dated September 1993 bearing the reference "BB154/2V". 2. No fuel shall be used other than cereal straw. |
The Farm 2000 model HT6 (when used with the Farm 2000 conversion kit HT60cx), the HT6PLUS and HT600 (when each is used with the Farm 2000 conversion kit HT70cx), and the HT7 and HT8 (when each is used with the Farm 2000 conversion kit HT80cx), manufactured by Farm 2000 Limited. | 1. The boilers shall be installed in accordance with the manufacturer's instructions dated May 1994 bearing the references "HT6780" and "HT6781", and maintained and operated in accordance with the manufacturer's instructions dated 1st July 1993 bearing the reference "HT60/70/80". 2. No fuel shall be used other than cereal straw. |
The Jotul catalyst stove models 8TDIC and 12TDIC manufactured by Jotul Limited. | 1. The appliances shall be installed, maintained and operated in accordance with the manufacturer's instructions dated November 1995 bearing the following reference:- (a)model 8TDIC: "JT8/001" and "J/S/001" (b)model 12TDIC: "JT12/001" and "JT/S/001" 2. No fuel shall be used other than wood. |
The RanHeat appliances models MSU150, MSU300, MSU500, WA150, WA300 and WA500, manufactured by Ranheat Engineering Limited. | 1. The fireplaces shall be installed, maintained and operated in accordance with the manufacturer's instructions dated July 1994 bearing the following reference:- (a)models MSU150, MSU300 and MSU500: "MSU150/5001994"; (b)models WA150, WA300 and WA500: "WA150/5001994". 2. The fireplaces shall be installed, maintained and operated in accordance with the manufacturer's instructions dated August 1995 bearing the reference "Issue C1000/C/Range". 2. No fuel shall be used other than chipboard or wood shavings, forestry chips or paper briquettes. |
The Talbott's Heating models T75, T150, T300, D250B, D500B and D700B, manufactured by Talbott's Heating Limited. | 1. The fireplaces shall be installed, maintained and operated in accordance with the manufacturer's instructions dated 1st January 1995 bearing the following reference:- (a)models T75, T150 and T300: "gen/sttech"; (b)models D250B, D500B and D700B: "Gen/Tech". 2. No fuel shall be used other than the following: (a)models T75, T150 and T300: wood offcuts, woodwaste pallets, chipboard, plastic coated chipboard, cardboard or paper; (b)models D250B, D500B and D700B: hardwood or softwood offcuts, chipboard, plastic coated chipboard or cardboard. |

Local authorities may declare the whole or any part of their district to be a smoke control area under section 18 of the Clean Air Act 1993. Section 20 of the Act generally prohibits the emission of smoke in smoke control areas. The Secretary of State may by order made under section 21 of the Act exempt specified classes of fireplace from the provisions of section 20, if he is satisfied that they can be used for burning fuel other than authorised fuels without producing any smoke or a substantial quantity of smoke.
This Order, which applies throughout Great Britain, exempts the classes of fireplace mentioned in the Schedule from the provisions of section 20 subject to conditions requiring installation, maintenance and operation in accordance with the relevant manufacturer's instructions and subject to certain conditions as to the fuel to be used. It also amends an earlier order so as to allow cardboard to be burnt in the classes of fireplace specified.
