The Education (Teachers) (Amendment) Regulations 1996

In exercise of the powers conferred by sections 218(1)(a) and 232(5) of the Education Reform Act 1988(1) the Secretary of State hereby makes the following regulations:

Citation and commencement

1.-(1) These Regulations may be cited as the Education (Teachers) (Amendment) Regulations 1996 and shall come into force on 1st August 1996.

(2) Any reference in these Regulations to the principal Regulations is a reference to the Education (Teachers) Regulations 1993(2).

Amendment of the principal Regulations

2. At the end of Part I of Schedule 2 to the principal Regulations there shall be inserted the following paragraph:

"Temporary teachers

3A.-(1) Subject to sub-paragraph (2) below, an unqualified teacher may be employed at a school (other than a pupil referral unit) if-

(a)he is recognised as a trained teacher by the competent authority in any country outside the United Kingdom, and

(b)he is employed in any one post at a school (whether by reason of the absence of the holder of that post or otherwise) for periods which do not exceed four months in total.

(2) This paragraph shall not apply in the case of an unqualified teacher after the expiry of a period of two years commencing with the day on which he is first employed as a teacher at a school."

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Education (Teachers) Regulations 1993 by adding to the cases and circumstances where a teacher employed at a school is exempted from the requirement to be a qualified teacher as defined by the 1993 Regulations. The new exemption applies where the teacher holds a teaching qualification recognised by a competent authority outside the United Kingdom and is in temporary employment as a teacher for a period of not more than two years. There is also a requirement that the teacher should not be employed in a particular post in a school for a period or periods of more than four months in total.

S.I. 1993/543; amended by S.I. 1993/1969, S.I. 1994/222 (which revoked S.I. 1993/1969), section 14 (2) of the Education Act 1994 (c. 30), S.I. 1995/602 and S.I. 1995/2594 and modified by S.I. 1994/2103. None of these amendments or modifications are relevant for the purposes of these Regulations with the exception of S.I. 1995/602 which added a definition of "pupil referral unit".
