The Local Government Act 1988 (Defined Activities) (Exemption) (Lambeth London Borough Council) Order 1996

The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.-(1) This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (Lambeth London Borough Council) Order 1996 and shall come into force on 5th August 1996.

(2) In this Order-

"the Borough" means the London borough of Lambeth; and

"the Council" means the council of that borough.

Exemption of activities

2.-(1) The collection of refuse and other catering(2) by the Council shall not be treated as defined activities so long as they are carried out before 1st April 1997.

(2) The cleaning of buildings(3) by the Council shall not be treated as a defined activity so long as it is carried out in the Angell, Clapham Common, Clapham Town, Ferndale, Herne Hill, Larkhall, Tulse Hill or Vassall wards of the Borough before 1st April 1997.

(3) The cleaning of buildings by the Council in any ward of the Borough, other than a ward mentioned in paragraph (2) above, shall not be treated as a defined activity so long as-

(a)it consists of the cleaning of drains and refuse chutes and chambers in any building in which there are dwellings provided by the Council; and

(b)it is carried out before 1st April 1997.

(4) Other cleaning(4) by the Council shall not be treated as a defined activity so long as-

(a)it consists of-

(i)the cleaning (by sweeping or otherwise) of any street; or

(ii)the emptying of gullies; and

(b)it is carried out before 1st April 1997.

Explanatory Note

(This note is not part of the Order)

Under Part I of the Local Government Act 1988 (competition), work falling within certain defined activities may be carried out by local authorities only if specified conditions are fulfilled.

This Order exempts a number of activities from the requirements of Part I so long as they are carried out by the Lambeth London Borough Council before 1st April 1997. The activities are-

(a)the collection of refuse;

(b)other catering;

(c)the cleaning of buildings in one or more specified wards or consisting of the cleaning of drains or refuse chutes in council housing; and

(d)other cleaning consisting of street cleaning or the emptying of gullies.
