DISABLED PERSONS

WHEREAS -
(1) in pursuance of sections 3(4) and 54(1) of the Disability Discrimination Act 1995(1) the Secretary of State has consulted such persons in preparing a draft of the Guidance and such organisations in preparing a draft of the Code of Practice as she considered appropriate;
(2) in pursuance of sections 3(5) and 54(2) of the said Act the Secretary of State has published a draft of the Guidance and of the Code of Practice and has considered such representations that were made to her about the drafts and has modified her proposals in the light of those representations as she considered appropriate;
(3) in pursuance of sections 3(6) and 54(3) of the said Act the Secretary of State has laid the draft of the Guidance and the draft of the Code of Practice before both Houses of Parliament and neither House of Parliament has resolved not to approve the drafts within a period of 40-days beginning with the day on which they were laid;
(4) in pursuance of sections 3(8) and 54(5) of the said Act the Secretary of State has issued the said Guidance and Code of Practice in the form of the drafts laid before both Houses of Parliament on 6th June 1996;
Now, therefore, the Secretary of State for Education and Employment, in exercise of the powers conferred on her by sections 3(9) and 54(6) of the Disability Discrimination Act 1995, hereby makes the following Order:
1. This Order may be cited as the Disability Discrimination (Guidance and Code of Practice) (Appointed Day) Order 1996.
2. The day appointed as the day on which the Guidance (on the matters to be taken into account in determining questions relating to the definition of disability)(2) issued pursuant to section 3 of the Disability Discrimination Act 1995 on 25th July 1996 shall come into force is 31st July 1996.
3. The day appointed as the day on which the Code of Practice (for the elimination of discrimination in the field of employment against disabled persons or persons who have had a disability)(3) issued pursuant to section 53 of the Disability Discrimination Act 1995 on 25th July 1996 shall come into force is 2nd December 1996.

The Disability Discrimination Act 1995 provides for the Secretary of State to issue Guidance on the matters to be taken into account in determining questions relating to the definition of disability. This Order appoints 31st July 1996 as the day on which this Guidance is to come into force.
The same Act provides for the Secretary of State to issue a Code of Practice for the elimination of discrimination in the field of employment against disabled persons or persons who have had a disability. Under this Order the Code of Practice is to come into force on 2nd December 1996.
