The Secretary of State, in exercise of the powers conferred on him by section 20(2) of the Education (Scotland) Act 1996(1) and of all other powers enabling him in that behalf, hereby makes the following Order:
1.-(1) This Order may be cited as the Scottish Qualifications Authority (Transitional Provisions) (Scotland) Order 1996 and shall come into force on 18th September 1996.
(2) In this Order, "the Act" means the Education (Scotland) Act 1996.
2. In terms of and for the purposes of section 20(2) of the Act the transitional period shall begin on 18th September 1996.

Part I of the Education (Scotland) Act 1996 enables the Secretary of State by order to establish a new statutory body called the Scottish Qualifications Authority. By order SQA was established at 18th September 1996, when most of the provisions of Part I of the Act came into force.
SQA will not take up its substantive functions immediately. The property, rights, liabilities and obligations of the Scottish Examination Board and the Scottish Vocational Education Council will be transferred to SQA as their successor at a future date to be appointed by the Secretary of State (the transfer date), and the provisions of the Act giving SQA substantive functions will be commenced then.
Section 20(1) of the Act provides that prior to the transfer date SQA shall have such of the functions to be conferred on it by Part I of the Act as are necessary or expedient to facilitate the transfer and facilitate or enable the effective carrying on by it of its functions after the transfer.
This Order in terms of section 20(2) of the Act sets the date when the transitional period provided for in section 20(1) of the Act shall begin.
