The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by section 2(3) and (4) of the Dogs (Fouling of Land) Act 1996(1), hereby make the following Regulations:
1.-(1) These Regulations may be cited as the Dogs (Fouling of Land) Regulations 1996 and shall come into force on 1st December 1996.
(2) In these Regulations, "order" means an order under section 2(1) of the Dogs (Fouling of Land) Act 1996.
2. An order shall be in the form set out in the Schedule to these Regulations, or a form substantially to the like effect as that form.
3.-(1) Before making an order, a local authority shall-
(a)publish notice of their proposal to do so in a local newspaper circulating in the area in which the land affected by the order is situated; and
(b)consider the representations (if any) made within the period specified in the notice.
(2) The notice referred to in paragraph (1) above shall-
(a)identify the land affected by the order;
(b)state the effect of the order;
(c)where the order will refer to a map, state the address of a place in the local authority's area where that map may be inspected by any person free of charge at all reasonable hours during the period mentioned in sub-paragraph (d) below; and
(d)state that representations may be made in writing within such period, being not less than 28 days after the publication of the notice, as may be specified in the notice, and the address to which representations may be sent.
4.-(1) An order may be made in respect of the land described in the notice referred to in regulation 3 above, or such part of that land as the local authority think fit.
(2) An order shall specify the day on which it is to come into force, being not less than 28 days after the day on which it is made.
5.-(1) The local authority shall, not less than 7 days before the day on which an order comes into force, publish in a local newspaper circulating in the area in which the land affected by the order is situated notice that the order has been made.
(2) The notice referred to in paragraph (1) above shall state the effect of the order and the place at which the order may be inspected and copies obtained.

These Regulations prescribe the form of orders to be made by local authorities under section 2 of the Dogs (Fouling of Land) Act 1996 designating land for the purposes of that Act, or amending or revoking such orders, and the procedure to be followed.
