In exercise of the powers conferred on him by section 102(4) of the Finance (No. 2) Act 1987(1), a draft of this Order having been laid before, and approved by a resolution of, the House of Commons, the Secretary of State hereby makes the following Order:
1. This Order may be cited as the Animals (Scientific Procedures) Act 1986 (Fees) (No. 1) Order 1996 and shall come into force on the day after it is made.
2.-(1) In relation to the functions mentioned in paragraph (2) below, the costs of which fall to be taken into account on the exercise of the power to fix the fees to which paragraph (3) below applies, the following matter, namely, any deficit incurred before the exercise of the relevant power, is hereby specified for the purposes of section 102(4) of the Finance (No. 2) Act 1987 as one which may be taken into account in determining those costs.
(2) The said functions are those of the Secretary of State, the inspectors and the Animal Procedures Committee under the Animals (Scientific Procedures) Act 1986(2).
(3) This paragraph applies to fees payable under section 8 of that Act.
