The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by section 48(2) of the Housing Act 1988(1) and of all other powers enabling them in that behalf, hereby make the following order:
1.-(1) This order may be cited as the Housing Associations (Permissible Additional Purposes) (England and Wales) Order 1996 and shall come into force on 1st April 1996.
(2) This Order extends to England and Wales only.
2.-(1) Section 4 of the Housing Associations Act 1985(2) (eligibility of housing associations for registration) shall be amended in accordance with the following provisions of this article.
(2) In subsection (3)-
(a)after paragraph (f), there shall be inserted-
"(ff)in England and Wales, disposing of houses by way of sale at less than market value to residents of the association;";
(b)in sub-paragraph (i) of paragraph (g), the words "(other than houses held by or for the association)" shall be omitted; and
(c)in sub-paragraph (ii) of that paragraph, the words "on land belonging to other persons" shall be omitted.
(3) In subsection (5), in the definition of "assured percentage arrangements", the words "(other than a house held at that time by or for the association)" shall be omitted.

This Order amends, with respect to England and Wales only, section 4 of the Housing Associations Act 1985, which sets out the conditions of eligibility of housing associations for registration under the Act.
A new permissible purpose or object is inserted, of disposing of houses to residents of the association in question at less than the market value. In addition, an existing purpose or object relating to assisting residents to acquire houses or procure the construction of houses is amended. The amendments remove the restrictions that prevent the houses in question being those of the association or constructed on the association's land.
