The Secretary of State, in exercise of the powers conferred on him by sections 8(1) and 15(6) of the Local Government Act 1988(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Local Government Act 1988 (Defined Activities) (Specified Periods) (Scotland) Regulations 1996 and shall come into force on 1st May 1996.
2. These Regulations (other than regulation 5 below) apply only to work to be carried out by a local authority in Scotland on or after 1st May 1996 in respect of the defined activities specified at section 2(2)(a), (b), (c), (d), (e), (ee), (f), (g), (gg) and (i) of the Local Government Act 1988(2).
3. The second condition, set out in section 7(3) of the Local Government Act 1988, shall not be treated as fulfilled as respects a defined activity to which these Regulations apply if the period stated in the detailed specification by virtue of section 7(3)(c) is less than three years or exceeds seven years.
4. The Local Government Act 1988 (Defined Activities) (Specified Periods) (Scotland) Regulations 1988(3) and regulation 4 of the Local Government Act 1988 (Defined Activities) (Competition and Specified Periods) (Scotland) Regulations 1990(4) shall not apply to work to which these Regulations apply.
5. The Local Government Act 1988 (Defined Activities) (Specified Periods) (Scotland) Amendment Regulations 1993(5) are hereby revoked.

These Regulations specify the minimum and maximum periods for which Scottish local authorities, joint boards and joint committees may invite offers to carry out work in respect of certain of the activities which must be open to competition under Part I of the Local Government Act 1988.
The Regulations will apply to the defined activities of collection of refuse, cleaning of buildings (including police buildings), other cleaning, catering for purposes of schools and welfare, other catering, managing sports and leisure facilities, maintenance of ground, repair and maintenance of vehicles, management of vehicles and security work.
Regulations relating to specified contract periods for development corporations (which are in the process of being wound up) are revoked.
Section 2(2)(b) includes cleaning of police buildings as a defined activity by virtue of article 3 of the Local Government Act 1988 (Competition) (Defined Activities) Order 1995 (S.I. 1995/1915); section 2(2)(ee) was inserted by the Local Government Act 1988 (Competition in Sports and Leisure Facilities) Order 1989 (S.I. 1989/2488); section 2(2) (gg) and (i) was inserted by the Local Government Act 1988 (Competition) (Defined Activities) Order 1994 (S.I. 1994/2884).
