The Secretary of State, in exercise of powers conferred on him by section 41(3) of the National Health Service (Primary Care) Act 1997(1) and of all other powers enabling him in that behalf, hereby makes the following Order:-

Citation and interpretation

1.-(1) This Order may be cited as the National Health Service (Primary Care) Act 1997 (Commencement No. 1) Order 1997.

(2) In this Order, "the Act" means the National Health Service (Primary Care) Act 1997.

Appointed days

2.-(1) 15th August 1997 is the day appointed for the coming into force of the provisions of the Act specified in column (1) of the Schedule to this Order (the subject matter of each provision being mentioned in column (2)).

(2) 22nd August 1997 is the day appointed for the coming into force of section 4 of the Act (proposals for pilot schemes), in so far as it relates to pilot schemes under which personal medical services are provided.

(3) 1st September 1997 is the day appointed for the coming into force of section 31 of the Act (provision of certain services under NHS contracts).

Explanatory Note

(This note is not part of the Order)

This Order brings into force certain provisions of the National Health Service (Primary Care) Act 1997 ("the 1997 Act").

Provisions which are brought into force on 15th August 1997 relate to the relationship between provisions on pilot schemes in the 1997 Act and certain provisions of the National Health Service Act 1977 or the National Health Service (Scotland) Act 1978, as the case may be; preferential treatment for practitioners who wish to be included in medical lists after ceasing to provide personal medical services under a pilot scheme; the funding of work preparatory to participation in a pilot scheme; the provision of additional pharmaceutical services and the duty of registered opticians to refer certain persons to registered medical practitioners.

Other provisions, which are brought into force on 22nd August 1997, relate to the preparation of proposals for pilot schemes for the provision of personal medical services under the 1997 Act.

Provisions which are brought into force on 1st September 1997 relate to the provision of certain optical and pharmaceutical services under NHS contracts.
