The Minister of Agriculture, Fisheries and Food in relation to England and the Secretary of State for Wales in relation to Wales, in exercise of the powers conferred on them by section 56 of the Finance Act 1973(1) and of all other powers enabling them in that behalf, with the consent of the Treasury, hereby make the following Regulations:

Title and commencement

1. These Regulations may be cited as the Plant Passport (Plant Health Fees) (England and Wales) (Amendment) Regulations 1997 and shall come into force on 1st September 1997.

Amendment of the Plant Passport (Plant Health Fees) (England and Wales) Regulations 1993

2. For the Schedule to the Plant Passport (Plant Health Fees) (England and Wales) Regulations 1993(2), there shall be substituted the Schedule set out in the Schedule to these Regulations.

Regulation 3

"SCHEDULEFEES FOR INSPECTIONS FOR PLANT PASSPORTING PURPOSES

£20.25 for each quarter of an hour or part thereof spent on site by an inspector with a minimum of £40.50 in respect of any visit."

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which extend only to England and Wales, amend the Plant Passport (Plant Health Fees) (England and Wales) Regulations 1993 (S.I. 1993/1642) ("the principal Regulations") in order to increase the level of fees payable under the principal Regulations.

The principal Regulations require fees to be paid in respect of inspections carried out for the purposes of conferring authority to issue plant passports under article 17 of the Plant Health (Great Britain) Order 1993 (S.I. 1993/1320) (as amended). The 1993 Order implements Council Directive 77/93/EEC (as amended and supplemented by the instruments listed in Schedule 16 to the 1993 Order) (OJ No. L26, 31.1.77, p.20) under which certain plants, plant products and other objects require a plant passport for movement within the European Community, including trade within the United Kingdom.

In the principal Regulations, the fee per quarter of an hour or part thereof spent on site by an inspector was £17.50 and the minimum fee in respect of any visit was £35. In these Regulations, those fees are £20.25 and £40.50 respectively.

A Compliance Cost Assessment in relation to these Regulations has been placed in the libraries of both Houses of Parliament, and copies can be obtained from the Plant Health Division of the Ministry of Agriculture, Fisheries and Food, Foss House, Kings Pool, 1-�2 Peasholme Green, York YO1 2PX.
