The Local Government Changes for England (Direct Labour Organisations) (County of Leicestershire and District of Rutland) Order 1997

The Secretary of State, in exercise of the powers conferred on him by sections 17 and 26(4) of the Local Government Act 1992(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Local Government Changes for England (Direct Labour Organisations) (County of Leicestershire and District of Rutland) Order 1997 and shall commence on 12th November 1997.

Exemption from Part III Local Government, Planning and Land Act 1980

2. A contract for the carrying out by Leicestershire County Council of works in the district of Rutland before 30th September 1998 shall not be treated as a works contract for the purposes of Part III of the Local Government, Planning and Land Act 1980(2) (Direct Labour Organisations).

Exemption from Part I Local Government Act 1988

3. Catering for the purposes of schools and welfare shall not be treated as a defined activity for the purposes of Part I of the Local Government Act 1988(3) (Competition) so long as it is carried out by Leicestershire County Council in the district of Rutland before 30th September 1998.

Explanatory Note

(This note is not part of the Order)

The Leicestershire (City of Leicester and District of Rutland) (Structural Change) Order 1997 (SI 1996/507) effected structural and boundary changes affecting the county of Leicestershire and the district of Rutland.

Under Part III of the Local Government, Planning and Land Act 1980 (Direct Labour Organisations) and Part I of the Local Government Act 1988 (competition), work contracts may be let by local authorities, and work falling within certain defined activities may be carried out by local authorities, only if particular conditions are fulfilled. Following the structural changes to Leicestershire and Rutland, this Order exempts Leicestershire County Council and the Council of the district of Rutland from those conditions for a transitional period ending on 30th September 1998.
