The Secretary of State, in exercise of the powers conferred by section 4(1) of the Transport and Works Act 1992(1) and of all other powers enabling him in that behalf, hereby makes the following Order, a draft of which has been approved by resolution of each House of Parliament:-
1. This Order may be cited as the Transport and Works (Descriptions of Works Interfering with Navigation) (Amendment) Order 1997, and shall come into force on the seventh day after the day on which it is made.
2. Article 2 of the Transport and Works (Descriptions of Works Interfering with Navigation) Order 1992(2) shall be amended by inserting:
(a)after "(c) cable;" the words "(cc) fountain;"; and
(b)after "(e) navigational aid;" the words "(ee) observation structure;".
3. Article 3(1) of the Transport and Works (Descriptions of Works Interfering with Navigation) Order 1992 shall be amended:
(a)by inserting after the definition of "cable" the following:
""fountain" means a structure or device (whether fixed or floating) used, or intended to be used, to project jets of water from static or manoeuvrable nozzles;";
(b)by inserting after the definition of "navigational aid" the following:
""observation structure" means a structure (whether fixed or floating) with a platform or gallery for viewing events, objects or the surrounding region;"; and
(c)in the definition of "pier" by inserting after the words "(whether fixed or floating)" the words ", together with any building thereon," and by substituting for the words "promenading or other recreational purposes" the words "commercial, residential or leisure purposes".

This Order amends the Transport and Works (Descriptions of Works Interfering with Navigation) Order 1992. It amends the meaning of "pier" to include commercial and residential developments with buildings. It also adds two works interfering with navigation, fountains and observation structures, to those prescribed in that Order. More detailed descriptions of the works appear in article 3 of this Order.
