The European Communities (Definition of Treaties) (European Police Office) Order 1997

Coming into force in accordance with Article 1

The Queen's Most Excellent Majesty in Council

Whereas a draft of this Order has been laid before Parliament in accordance with section 1 of the European Communities Act 1972(1) ("the Act") and has been approved by a resolution of each House of Parliament:

Now, therefore, Her Majesty, by virtue and in exercise of the powers conferred on Her by section 1(3) of the Act or otherwise in Her Majesty vested, is pleased by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-

1. This Order may be cited as the European Communities (Definition of Treaties) (European Police Office) Order 1997 and shall come into force on the date on which the Protocol drawn up, on the basis of Article K.3 of the Treaty of European Union and Article 41(3) of the Europol Convention, on the Privileges and Immunities of Europol, the members of its organs, the Deputy Directors and employees of Europol signed at Brussels on 19th June 1997(2) enters into force in respect of the United Kingdom. That date shall be notified in the London, Edinburgh and Belfast Gazettes.

2. The Treaty specified in the Schedule to this Order is to be regarded as a Community Treaty as defined in section 1(2) of the European Communities Act 1972.

SCHEDULE

Protocol drawn up, on the basis of Article K.3 of the Treaty of European Union and Article 41(3) of the Europol Convention, on the Privileges and Immunities of Europol, the members of its organs, the Deputy Directors and employees of Europol.

Explanatory Note

(This note is not part of the Order)

This Order declares the Protocol drawn up, on the basis of Article K.3 of the Treaty of European Union and Article 41(3) of the Europol Convention, on the Privileges and Immunities of Europol, the members of its organs, the Deputy Directors and employees of Europol (Cm. 3767) to be a Community Treaty as defined in section 1(2) of the European Communities Act 1972. The principal effect of declaring the Protocol to be a Community Treaty as so defined is to bring into play, in relation to it, the provisions of section 2 of the European Communities Act 1972 which provides for the implementation of Treaties so specified.
