The Secretary of State, in exercise of the powers conferred on him by sections 5(2), (3) and (4) and 60(1) of the Social Work (Scotland) Act 1968(1), sections 3(1A), 9, 27(2) and 51A of the Adoption (Scotland) Act 1978(2), sections 17, 31, 38(2), 44(5), 62, 75, 103(2) of the Children (Scotland) Act 1995(3) and section 44(5) of the Criminal Procedure (Scotland) Act 1995(4), and all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and revocations

1.-(1) These Regulations may be cited as the Children (Scotland) Act 1995 etc. (Revocations and Savings) (Scotland) Regulations 1997 and shall come into force on 1st April 1997.

(2) The regulations listed in the Schedule shall be revoked on the coming into force of these Regulations.

Savings

2. Approval of accommodation in residential establishments as secure accommodation granted by the Secretary of State prior to 1st April 1997 in terms of regulation 3 of the Secure Accommodation (Scotland) Regulations 1983(5) and in force immediately prior to 1st April 1997 shall after that date continue in force as if made under regulation 3 of the Secure Accommodation (Scotland) Regulations 1996(6) and shall be subject to those regulations.

3. Approval of a person as a foster parent given under regulation 7 of the Boarding-out and Fostering of Children (Scotland) Regulations 1985(7) by a care authority prior to 1st April 1997 and in force immediately prior to 1st April 1997 shall for the year after that date continue in force as if the approval were made by a local authority of a foster carer under regulation 7 of the Fostering of Children (Scotland) Regulations 1996(8) and shall be subject to those regulations.

Explanatory Note

(This note is not part of the Order)

These Regulations revoke the regulations listed in the Schedule. Article 2 keeps in force approval of accommodation in residential establishments as secure accommodation given under the Secure Accommodation (Scotland) Regulations 1983 after the revocation of those regulations. Article 3 keeps in force approval of a person as a foster parent given under the Boarding-out and Fostering of Children (Scotland) Regulations 1985 after the revocation of those regulations.
