The Secretary of State for Health, in exercise of the power conferred by section 7(3) of the Community Care (Direct Payments) Act 1996(1) and of all other powers enabling him in that behalf, hereby makes the following Order:-
1. This Order may be cited as the Isles of Scilly (Direct Payments Act) Order 1997 and shall come into force on 1st April 1997.
2. Sections 1 and 2 of the Community Care (Direct Payments) Act 1996 shall apply to the Isles of Scilly as if the Council of the Isles of Scilly(2) were a local authority within the meaning of those sections.

This Order provides that sections 1 and 2 of the Community Care (Direct Payments) Act 1996 ("the Act") apply to the Isles of Scilly as if the Council of the Isles of Scilly were a local authority for the purposes of those sections.
The Act enables local authorities responsible for providing (or arranging the provision of) community care services to make payments to persons in respect of their securing the provision of such services.
See section 265 of the Local Government Act 1972 (c. 70).
