Her Majesty, in pursuance of section 9(2) of the United Nations Personnel Act 1997(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-

Citation and commencement

1. This Order may be cited as the United Nations Personnel (Guernsey) Order 1998 and shall come into force on the day on which the Order is registered in the Royal Court of Guernsey.

Extension

2. The provisions of the United Nations Personnel Act 1997 which are listed in Part I of the Schedule to this Order shall extend to the Bailiwick of Guernsey with the exceptions, adaptations and modifications specified in Part II of that Schedule.

Article 2

SCHEDULEEXTENSION OF PROVISIONS OF THE UNITED NATIONS PERSONNEL ACT 1997 TO THE BAILIWICK OF GUERNSEY

PART IPROVISIONS EXTENDED

Section 1 (attacks on UN workers).

Section 2 (attacks in connection with premises and vehicles).

Section 3 (threats of attacks on UN workers).

Section 4 (meaning of UN worker).

Section 5 (provisions supplementary to sections 1 to 3).

Section 6 (extradition).

Section 8 (interpretation).

PART IIEXCEPTIONS, ADAPTATIONS AND MODIFICATIONS TO THE PROVISIONS OF THE UNITED NATIONS PERSONNEL ACT 1997 WHICH ARE EXTENDED TO THE BAILIWICK OF GUERNSEY BY PART I OF THIS SCHEDULE

1. In section 1 (attacks on UN workers):

(a)in subsection (1):

(i)after the words "United Kingdom", where they first occur, there shall be inserted the words "and the Bailiwick of Guernsey"; and

(ii)for the words "United Kingdom", wherever they next occur, there shall be substituted the words "Bailiwick of Guernsey"; and

(b)for subsection (2) there shall be substituted the following subsection:

"(2) The offences referred to in subsection (1) are-

(a)murder, manslaughter, rape, unlawful wounding with intent, grievous bodily harm with intent, unlawful wounding, grievous bodily harm, common assault, administering poison with intent to injure, annoy or aggrieve, and kidnapping; and

(b)an offence under section 2 of the Explosive Substances Law, 1939, as amended."(2).

2. In section 2 (attacks in connection with premises and vehicles):

(a)in subsection (1):

(i)after the words "United Kingdom", where they first occur, there shall be inserted the words "and the Bailiwick of Guernsey"; and

(ii)for the words "United Kingdom", wherever they next occur, there shall be substituted the words "Bailiwick of Guernsey"; and

(b)for subsection (2) there shall be substituted the following subsection:

"(2) The offences referred to in subsection (1) are-

(a)an offence under section 2 of the Explosive Substances Law, 1939; and

(b)an offence under section 1 of the Criminal Damage (Bailiwick of Guernsey) Law, 1983.".

3. In section 3 (threats of attacks on UN workers), for the words "United Kingdom" there shall be substituted the words "Bailiwick of Guernsey".

4. In section 5 (provisions supplementary to sections 1 to 3), subsections (1) and (2) shall be omitted.

5. In section 6 (extradition), at the end of subsection (1), there shall be added the words "as this Act has effect in the United Kingdom".

Explanatory Note

(This note is not part of the Order)

This Order extends those provisions of the United Nations Personnel Act 1997 which are set out in Part I of the Schedule to this Order to the Bailiwick of Guernsey; the provisions are subject to the exceptions, adaptations and modifications specified in Part II of that Schedule.
