Whereas, following the referral to it of a proposal by the Secretary of State in accordance with subsection (2) of section 368 of the Education Act 1996(1), Awdurdod Cymwysterau, Cwricwlwm ac Asesu Cymru or the Qualifications, Curriculum and Assessment Authority for Wales ("the Authority")(2) has, in accordance with subsection (3) of that section, given notice thereof to the bodies and persons referred to in that subsection and afforded them a reasonable opportunity of submitting evidence and representations as to the issues arising;
And whereas, in accordance with directions given by the Secretary of State under the said subsection (2), the Authority has submitted its report to the Secretary of State in accordance with subsection (4) of the said section 368;
And whereas the Authority has, after submitting its report to the Secretary of State, arranged for it to be published in accordance with subsection (5) of that section;
And whereas the Secretary of State has published a draft of the Regulations and sent copies of it to the Authority and all those who were consulted by the Authority, and has allowed a period of not less than one month for the submission of evidence and representations as to the issues arising in accordance with subsection (7) of that section:
Now therefore the Secretary of State for Wales, in exercise of the powers conferred on the Secretary of State by sections 356(2)(a) and (b) and (4) and 568(5) and (6) of the Education Act 1996, hereby makes the following Order in the terms of the said draft with modifications:
1.-(1) This Order may be cited as the Education (National Curriculum) (Attainment Targets and Programmes of Study in Physical Education) (Wales) Order 1998 and shall come into force on 31st August 1998.
(2) In this Order-
"the Document" means the Document published by Her Majesty's Stationery Office in January 1995 entitled "Physical Education in the National Curriculum"(3); and
references to the first, second, third and fourth key stages are to the periods mentioned in paragraphs (a), (b), (c) and (d) respectively of section 355(1) of the Education Act 1996.
(3) This Order applies only to schools in Wales.
2. The Education (National Curriculum) (Attainment Targets and Programmes of Study in Physical Education) Order 1995(4) is hereby revoked so far as it applies to schools in Wales.
3.-(1) Paragraph (2) below applies in relation to pupils in the first and second key stages at schools in Wales, but only in relation to the school years beginning in 1998 and 1999 respectively.
(2) It is hereby directed that the provisions relating to attainment targets and programmes of study set out in the Document shall have effect for the purpose of specifying the attainment targets and programmes of study in relation to physical education with the amendments specified in the Schedule.
(3) Paragraph (4) below applies-
(a)in relation to pupils in the first and second key stages at schools in Wales, but only in relation to school years beginning in or after 2000; and
(b)in relation to pupils in the third and fourth key stages at such schools (in relation to any school year).
(4) It is hereby directed that the provisions relating to attainment targets and programmes of study set out in the Document shall have effect for the purpose of specifying attainment targets and programmes of study in relation to physical education.
4. The examples printed in italics in the Document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

1. The Document is amended as follows.
2. In the section headed "KEY STAGE 1 PROGRAMME OF STUDY"-
in paragraph 2 (Gymnastic activities), sub-paragraph b is omitted; and
in paragraph 3 (Dance), sub-paragraphs a and b are omitted.
3. In the section headed "KEY STAGE 2 PROGRAMME OF STUDY"-
in paragraph 3 (Dance), sub-paragraph a is omitted;
paragraph 4 (Athletic activities), sub-paragraph b is omitted; and
paragraph 5 (Outdoor and adventurous activities), is omitted.
(This note is not part of the Order)
This Order provides for provisions specified in the Document published by Her Majesty's Stationery Office entitled "Physical Education in the National Curriculum" to have effect for the purpose of specifying attainment targets and programmes of study for physical education in relation to schools in Wales. In the case of pupils in the first and second key stages, for the school years beginning in 1998 and 1999 those provisions apply with the amendments specified in the Schedule to the Order, but otherwise all the provisions apply. Except for one very minor modification in article 2 (the addition of the words "so far as it applies to schools in Wales") the Order is in the terms of the draft Order on which the Secretary of State consulted in June/July 1998.
The Order, which comes into force on 31st August 1998, supersedes the provisions of the Education (National Curriculum) (Attainment Targets and Programmes of Study in Physical Education) Order 1995.
1996 c. 56. Section 368 is amended by paragraph 28 of Schedule 7 to the Education Act 1997 (c. 44).
Awdurdod Cymwysterau, Cwricwlwm ac Asesu Cymru or the Qualifications, Curriculum and Assessment Authority for Wales was established by section 14(1)(b) of the Education Reform Act 1988 (c. 40) under the name of the Curriculum Council for Wales, renamed as the Curriculum and Assessment Authority for Wales by section 253(1) of the Education Act 1993 (c. 35), continued in existence under that name by section 360 of the Education Act 1996 and given its current name by section 27(1) of the Education Act 1997.
