In exercise of the powers conferred on the Secretary of State by sections 356(2)(c) and (5) and 568(5) and (6) of the Education Act 1996(1), the Secretary of State for Wales hereby makes the following Order:
1. This Order may be cited as the Education (National Curriculum) (Assessment Arrangements for English, Welsh, Mathematics and Science) (Key Stage 2) (Wales) (Amendment) Order 1998 and shall come into force on 31st August 1998.
2.-(1) The Education (National Curriculum) (Assessment Arrangements for English, Welsh, Mathematics and Science) (Key Stage 2) (Wales) Order 1997(2) shall be amended as follows.
(2) In article 5, in paragraph (5) there is inserted after "English,", "Welsh,".

This Order makes one amendment to the Education (National Curriculum) (Assessment Arrangements for English, Welsh, Mathematics and Science) (Key Stage 2) (Wales) Order 1997. It specifies that National Curriculum tests in Welsh (First Language) are to be administered only to those pupils who are expected by the head teacher to achieve at least level 2 (bringing the provisions in the 1997 Order relating to Welsh NC tests in line with those relating to NC tests in English, mathematics and science).
