The Secretary of State, being a Minister designated(1) for the purpose of section 2(2) of the European Communities Act 1972(2) in relation to the control of the export of goods and measures relating to trade in dual-use goods, in exercise of the powers conferred on her by that section hereby makes the following Regulations:
1. These Regulations may be cited as the Dual-Use and Related Goods (Export Control) (Amendment) Regulations 1998 and shall come into force on 8th March 1998.
2. The following words shall be added at the end of the definition of "the Decision" in regulation 2 of the Dual-Use and Related Goods (Export Control) Regulations 1996(3):
"and by Council Decision No. 98/106/CFSP of 26th January 1998(4)".
3.-(1) Entry 1C911 and category 6 in Schedule 2 to the said Regulations are hereby revoked.
(2) Regulations 4 and 7 of the Dual-Use and Related Goods (Export Control) (Amendment No. 4) Regulations 1997(5) are hereby revoked.
4. The expression "3E990" in regulation 5 of the said Regulations of 1997 is hereby revoked.

The Dual-Use and Related Goods (Export Control) Regulations 1996, made in implementation of and pursuant to Council Regulation (EC) No. 3381/94 on the control of exports of dual-use goods (OJ No. L367, 31.12.94, p.1), contain references to Council Decision No. 94/942/CFSP on the joint action adopted by the Council of the European Union on the basis of Article J3 of the Treaty on European Union concerning the control of exports of dual-use goods (OJ No. L367, 31.12.94, p.8). The Decision has now been further amended by Council Decision No. 98/106/CFSP. These Regulations:
amend the 1996 Regulations so that references to Decision 94/942/CFSP are to that Decision as further amended by Decision 98/106/CFSP (regulation 2); and
revoke consequentially redundant matter in Schedule 2 to the 1996 Regulations and in subsequent amending Regulations (regulation 3).
These Regulations also revoke an erroneous amendment in those amending Regulations to a provision revoked elsewhere in those same amending Regulations (regulation 4).
