The Secretary of State for Health, in exercise of powers conferred on him by section 79A of, and paragraph 3(2) and 3(3) of Schedule 12 to, the National Health Service Act 1977(1) and all other powers enabling him in that behalf, hereby makes the following Regulations:-
1. These Regulations may be cited as the National Health Service (Dental Charges) Amendment Regulations 1998 and shall come into force on 1st April 1998.
2. In regulation 4 of the National Health Service (Dental Charges) Regulations 1989(2) (calculation of charges), in paragraph (5), for "£330" in both places where it occurs there shall be substituted "£340".
3. The National Health Service (Dental Charges) Amendment Regulations 1997(3) are hereby revoked.
4. Where, on or after 1st April 1998, appliances are supplied, or other general dental services are provided, in pursuance of a contract or arrangement for the provision of general dental services made before that date, regulation 4(5) of the National Health Service (Dental Charges) Regulations 1989 shall have effect in respect of that supply or other provision as if these Regulations had not come into force.

These Regulations further amend the National Health Service (Dental Charges) Regulations 1989 to increase from £330 to £340 the maximum charge payable by the patient for dental treatment and appliances, where the contract or arrangement leading to the provision of such treatment or appliances is made on or after 1st April 1998.
1977 c. 49; see s.128(1) as amended by the National Health Service and Community Care Act 1990 (c. 19), s.26(2)(g) and (i), for the definitions of "prescribed" and "regulations". Section 79A was inserted by the Health and Medicines Act 1988 (c. 49), s.11(3).
S.I. 1989/394; relevant amending instruments are S.I. 1991/581, 1992/369, 1993/419, 1994/530, 1995/444, 1996/389 and 1997/558.
S.I. 1997/558, which will be spent on the coming into force of these Regulations.
