The Home Energy Efficiency Scheme (Amendment) (Scotland) Regulations 1999

The Secretary of State, in exercise of the powers conferred on him by section 15 of the Social Security Act 1990(1) and of all other powers enabling him in that behalf, and with the consent of the Treasury, hereby makes the following Regulations:

Citation, commencement and interpretation

1.-(1) These Regulations may be cited as the Home Energy Efficiency Scheme (Amendment) (Scotland) Regulations 1999 and shall come into force on 1st July 1999.

(2) In these Regulations, "the principal Regulations" means the Home Energy Efficiency Scheme Regulations 1997(2).

Extent and application

2. The amendments to the principal Regulations made by regulations 3 to 5 below shall extend to Scotland only and shall apply only in respect of applications for grant made on or after 1st July 1999.

Amendment of Regulations

3. In regulation 5 (purposes for which a grant may be approved) of the principal Regulations-�

(a)in paragraph (1), for "not more than one" there is substituted "one or more"; and

(b)in paragraph (2), after "one" there is inserted "or more".

4. In paragraph (1)(a) of regulation 6 (calculation of amount of grant) of the principal Regulations, for "£315" there is substituted "£500".

5. In paragraph (4)(f) of regulation 7 (applications for grant) of the principal Regulations-�

(a)after "has", there is inserted ", relative to the dwelling in question,"; and

(b)for the words after "respect of", there is substituted-�

Explanatory Note

(This note is not part of the Regulations)

The Home Energy Efficiency Scheme Regulations 1997 provide for the making of grants for the improvement of energy efficiency in dwellings occupied by persons on low income or elderly persons. These Regulations amend those 1997 Regulations as regards Scotland only. They allow a works application for a grant to be approved for more than one of the purposes specified in regulation 5(1) of the 1997 Regulations, alter the maximum amount payable as grant in respect of a works application, and change the nature of the statement which must be made in grant applications about previous grants paid or applied for relative to the dwelling in question.
