The Disability Rights Commission Act 1999 (Commencement No. 1 and Transitional Provision) Order 1999

The Secretary of State, in exercise of the powers conferred on him by section 16(2) and (3) of the Disability Rights Commission Act 1999(1), hereby makes the following Order:-

Citation

1. This Order may be cited as the Disability Rights Commission Act 1999 (Commencement No. 1 and Transitional Provision) Order 1999.

Commencement of provisions concerning the Disability Rights Commission

2. The following provisions of the Disability Rights Commission Act 1999 (the "Act") shall come into force on 6th August 1999-

(1)subsections (1) to (3) of section 1 (establishment of the Disability Rights Commission);

(2)section 12 (regulations);

(3)section 13 (interpretation);

(4)subsection (1) of section 14 in so far as it relates to paragraphs 1, 2 and 4 of Schedule 4 (minor and consequential amendments);

(5)section 15 (Crown application);

(6)Schedule 1 (establishment of the Disability Rights Commission, constitution etc.); and

(7)paragraphs 1, 2 and 4 of Schedule 4 (minor and consequential amendments).

Transitional provision

3. Until the coming into force of section 1(4) of the Act, paragraph 3 of Part III of Schedule 5 to the Scotland Act 1998(2) (reserved bodies) shall apply to the National Disability Council, in addition to the Disability Rights Commission, notwithstanding the deletion of the reference to the National Disability Council by paragraph 4 of Schedule 4 to the Act.

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 6th August 1999 subsections (1) to (3) of section 1 of, and Schedule 1 to, the Disability Rights Commission Act 1999 which relate to the establishment of the Disability Rights Commission, together with sections 12, 13, 14(1) (in so far as it relates to paragraphs 1, 2 and 4 of Schedule 4), and 15 and paragraphs 1, 2 and 4 of Schedule 4 concerning interpretative and supplementary provisions. The amendment made by paragraph 4 of Schedule 4 to the Disability Rights Commission Act 1999 is subject to a transitional provision preserving the application of paragraph 3 of Part III of Schedule 5 to the Scotland Act 1998 to the National Disability Council.
