In exercise of powers conferred on the Secretary of State by sections 356(2)(c) and (5) and 568(5) of the Education Act 1996(1), the Secretary of State for Education and Employment hereby makes the following Order:
1. This Order may be cited as the Education (National Curriculum) (Key Stage 1 Assessment Arrangements) (England) (Amendment) Order 2000 and shall come into force on 28th April 2000.
2.-(1) The Education (National Curriculum) (Key Stage 1 Assessment Arrangements) (England) Order 1999(2) shall be amended as follows.
(2) In article 5 there shall be inserted at the end the following paragraph-
"(8) As soon as reasonably practicable after standard test and task assessments have been administered to pupils pursuant to sub-paragraph (1), the head teacher shall provide the local education authority with a signed statement, confirming that those standard test and task assessments were administered in accordance with the provisions of the document in which they were published."(3).

This Order amends the Education (National Curriculum) (Key Stage 1 Assessment Arrangements) (England) Order 1999. That Order specifies the assessment arrangements for the core subjects in the final year of the first key stage. The only change made to those regulations is the introduction of a statutory duty on the part of the head teacher to provide a signed statement to the local education authority confirming that the assessment arrangement test and tasks were administered in accordance with the provisions of the document in which they were published.
S.I. 1999/1236, to which there are amendments not relevant to this Order.
As at the date this Order is made, the document is entitled "Key Stage 1 1999 Assessment and Reporting Arrangements" (reference number QCA/98/262) and is published by the Qualifications and Curriculum Authority, which body was established under section 21 of the Education Act 1997 (c. 44).
