Coming into force in accordance with article 1

The Secretary of State for the Environment, Transport and the Regions makes this Instrument in exercise of powers conferred by section 106(3) of the Highways Act 1980(1) and now vested in him(2) and of all other powers enabling him in that behalf:

1. This Instrument may be cited as "The Devon County Council (Yeo Bridge Barnstaple) Scheme 1999 Confirmation Instrument 2000" and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

2. The Devon County Council (Yeo Bridge Barnstaple) Scheme 1999 ("the Scheme") is hereby confirmed with modifications.

3. The Scheme as confirmed is set out in the Schedule hereto (including the plan) and copies of the Scheme with its accompanying plan as modified are deposited at the offices of the Department of the Environment, Transport and the Regions, Floor 13, Ashdown House, St. Leonards on Sea, Hastings, East Sussex TN37 7GA, and at the offices of North Devon District Council at the Civic Centre, Barnstaple, Devon.

THE SCHEDULETHE DEVON COUNTY COUNCIL(YEO BRIDGE BARNSTAPLE) SCHEME 1999

The Devon County Council of County Hall, Topsham Road, Exeter, Devon (hereinafter referred to as "the Council") makes this Scheme in exercise of their powers under section 106(3) of the Highways Act 1980 and of all other powers enabling them in that behalf:-

1. The Council are authorised to construct over the navigable waters of the River Yeo the bridge specified in the Schedule to this Scheme as part of the highway which they are proposing to construct between a point 280 metres west of the River Yeo and Commercial Road in the Borough of Barnstaple in the said County.

2. This Scheme may be cited as the Devon County Council (Yeo Bridge Barnstaple) Scheme 1999.

Given under the Common Seal of the Council on the 28th day of April 1999.

THE SCHEDULE TO THE SCHEMEPLAN AND SPECIFICATIONS OF THE YEO BRIDGE

Points of Commencement and Termination

From a point on the south east bank of the River Yeo, 203 metres north west of the western corner of nos. 23-�28 Castle Quay Court boundary.

To a point on the north west bank of the River Yeo, 11 metres south east of the south eastern corner of Corporation Yard.

Spans

A single span of 31.5 metres overall.

A swinging span of 15.5 metres.

A navigable span of 10 metres.

Headway

At Ordnance Survey grid reference SS553334 not less than 2.5 metres above the mean high water spring tide level of 4.7 metres AOD.

Waterway

A minimum clear navigable waterway of 10 metres.

Overall Dimensions

The bridge will be 4 metres wide overall and will carry a 3 metre wide cycletrack with a right of way on foot.

Operation

The bridge will be operated remotely from a 24-hour manned control room in Barnstaple where the bridge will be monitored by closed circuit television. The bridge will be operated following request to the control room via dedicated line telephone boxes with auto dialler located at the moorings in Rolle Quay and Castle Quay and also by the use of VHF radio.
