Whereas a draft of this Order has been laid before and approved by a resolution of each House of Parliament:

Now, therefore, the Secretary of State, in exercise of the powers conferred upon him by section 32(3) of the Data Protection Act 1998(1), and after consultation with the Data Protection Commissioner in accordance with section 67(3) of that Act, hereby makes the following Order:

1. This Order may be cited as the Data Protection (Designated Codes of Practice) (No. 2) Order 2000 and shall come into force on the fourteenth day after the day on which it is made.

2. The codes of practice listed in the Schedule to this Order shall be designated for the purposes of section 32(3) of the Data Protection Act 1998.

3. The Data Protection (Designated Codes of Practice) Order 2000(2) is hereby revoked.

SCHEDULEDESIGNATED CODES OF PRACTICE

1. The code published by the Broadcasting Standards Commission under section 107 of the Broadcasting Act 1996(3).

2. The code published by the Independent Television Commission under section 7 of the Broadcasting Act 1990(4).

3. The Code of Practice published by the Press Complaints Commission.

4. The Producers' Guidelines published by the British Broadcasting Corporation.

5. The code published by the Radio Authority under section 91 of the Broadcasting Act 1990.

Explanatory Note

(This note is not part of the Order)

Article 2 of this Order designates for the purposes of section 32(3) of the Data Protection Act 1998 the codes of practice listed in the Schedule to this Order. Compliance with any of the designated codes may be taken into account when considering for the purposes of section 32(1)(b) of the Act whether the belief of a data controller that the publication of any journalistic, literary or artistic material would be in the public interest was reasonable.

This Order revokes and replaces the Data Protection (Designated Codes of Practice) Order 2000. That Order sought to refer to each code by reference to the date of issue. In relation to one code the issue referred to had been superseded by a subsequent issue by the date on which the Order was made. This Order does not refer to dates of issue.

A Regulatory Impact Assessment was prepared for the Data Protection Bill as it was then and the statutory instruments to be made under it, and was placed in the libraries of both Houses of Parliament. The Regulatory Impact Assessment is now available on the internet at www.homeoffice.gov.uk. Alternatively, copies can be obtained by post from the Home Office, LGDP Unit, 50 Queen Anne's Gate, London SW1H 9AT.
