The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by sections 1, 2(1) and (5), 3 and 20 of the International Carriage of Perishable Foodstuffs Act 1976(1), hereby makes the following Regulations:
1. These Regulations may be cited as the International Carriage of Perishable Foodstuffs (Amendment) Regulations 2000 and shall come into force on 1st January 2001.
2. In regulation 2 (Interpretation and transitional provision) of the International Carriage of Perishable Foodstuffs Regulations 1985(2) for the definition of "ATP" there shall be substituted:
""ATP" means the Agreement on the International Carriage of Perishable Foodstuffs and on the Special Equipment to be used for such Carriage (ATP) concluded at Geneva on 1st September 1970 as amended pursuant to Article 18 of the Agreement(3) and as further amended pursuant to that Article by an amendment to Article 18 which came into force on 15 May 1991(4), an amendment to Article 5 which came into force on 30 April 1999(5), an addition to Article 10 which came into force on 30 April 1999(6) and amendments to Annex 1, Appendix 2 which came into force on 30 April 1999(7);".

These Regulations amend the definition in regulation 2 of the International Carriage of Perishable Foodstuffs Regulations 1985 of the Agreement on the International Carriage of Perishable Foodstuffs and on the Special Equipment to be used for such Carriage (ATP) concluded on 1st September 1970, to take into account further amendments to the Agreement.
Two of the amendments affect Articles 5 and 10 of the Agreement (ATP); a further amendment is to Annex 1 of the Agreement:
(a)the amendment to Article 5 clarifies the definition of containers when used for the transportation of perishable foodstuffs;
(b)the amendment to Article 10 prevents new Contracting Parties who choose not to apply ATP on their territories from blocking proposals to amend the Agreement;
(c)the amendment to Annex 1 is a text correction, to reflect the previously agreed increase in the period of validity of design type approval from three to six years.
