The Special Health Authorities (Duty of Quality) Regulations 2000

The Secretary of State for Health, in exercise of the powers conferred on him by section 126(4) of the National Health Service Act 1977(1) and section 18(3) of the Health Act 1999(2), hereby makes the following Regulations:

Citation, commencement and extent

1.-(1) These Regulations may be cited as the Special Health Authorities (Duty of Quality) Regulations 2000 and shall come into force on 1st April 2000.

(2) These Regulations extend to England only.

Extension of the duty of quality

2. The duty in section 18 of the Health Act 1999 (duty of quality) shall extend to the following Special Health Authorities-�

(a)the National Blood Authority(3);

(b)the Ashworth Hospital Authority(4);

(c)the Broadmoor Hospital Authority(5);

(d)the Rampton Hospital Authority(6).

Explanatory Note

(This note is not part of the Regulations)

These Regulations extend the duty in section 18 of the Health Act 1999, to put and keep in place arrangements for the purpose of monitoring and improving the quality of health care which an NHS body provides to individuals, to the National Blood Authority and to the Ashworth, Broadmoor and Rampton Hospital Authorities. The Regulations extend only to England.

1977 c. 49; section 126(4) applies in relation to any power to make orders or regulations conferred by the Health Act 1999 (c. 8) (" the 1999 Act") (see section 62(4) of the 1999 Act) and was amended by the National Health Service and Community Care Act 1990 (c. 19) ("the 1990 Act"), section 65(2) and the 1999 Act, Schedule 4, paragraph 37(6).

1999 c. 8. The functions of the Secretary of State under this provision and section 126(4) of the National Health Service Act 1977 (" the 1977 Act") are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2(a) of, and the entries for the 1977 Act and the 1999 Act in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672, as amended by section 66(5) of the 1999 Act.
