The Secretary of State for Transport, Local Government and the Regions, in exercise of the powers conferred by section 6(3)(a), (8)(a) and (9)(a) of the Transport Act 1985[1], and after consultation with representative organisations in accordance with section 61(2) of the Public Passenger Vehicles Act 1981[2], hereby makes the following Regulations:
Citation, commencement and extent
1.
- (1) These Regulations may be cited as the Public Service Vehicles (Registration of Local Services) (Amendment) (England and Wales) Regulations 2002 and shall come into force on 1st March 2002.
(2) These Regulations extend to England and Wales only[3].
Amendment of the principal regulations
2.
- (1) The Public Service Vehicles (Registration of Local Services) Regulations 1986[4] shall be amended as follows.
(2) In Regulation 5(1)(a) for "42 days" substitute "56 days".
(3) Regulation 9(2)(c) is revoked.
Transitional provisions
3.
Regulation 2(2) shall not apply in relation to any registration, or any application to vary or cancel a registration, in respect of which an application is made before the date of the coming into force of these Regulations.

EXPLANATORY NOTE
(This note is not part of the Order)
These Regulations further amend the Public Service Vehicles (Registration of Local Services) Regulations 1986 ("the principal Regulations") in respect of England and Wales. The Regulations replace the 42 day period of notice, as prescribed by Regulation 5 of the principal Regulations for registering or applying to vary or cancel a registration of a local service, with a period of notice of 56 days. The Regulations further revoke Regulation 9(2)(c) of the principal Regulations, which permitted a registered service to be varied to a time either 5 minutes earlier or 5 minutes later than the registered time without the need to vary the prescribed particulars of the service.
