EDUCATION, ENGLAND

The Education (Teacher Training Bursaries) (England) Regulations 2002

  Made 6th March 2002 
  Laid before Parliament 7th March 2002 
  Coming into force 1st April 2002 

In exercise of the powers conferred on the Secretary of State by sections 50 and 63(3) of the Education (No.2) Act 1986[1], the Secretary of State for Education and Skills hereby makes the following Regulations:

Citation, commencement and application
     1.  - (1) These Regulations may be cited as the Education (Teacher Training Bursaries) (England) Regulations 2002 and shall come into force on 1st April 2002.

    (2) These Regulations shall only apply in relation to England.

Interpretation
    
2. In these Regulations:

Bursaries
     3.  - (1) The Secretary of State may pay grants to a governing body of an institution in respect of expenditure incurred or to be incurred by such a governing body in providing bursaries to persons undertaking, or proposing to undertake:

    (2) The payment of grants in pursuance of this regulation shall be dependent on the fulfilment of such conditions as may be determined by the Secretary of State.

Repayment
    
4. Where in the opinion of the Secretary of State any information or assumption on the basis of which a grant has been paid is incorrect, the person to whom the grant was paid shall at the request of the Secretary of State repay such sum not exceeding the total grant as the Secretary of State may request.

Revocation
    
5. The Education (Teacher Training Bursaries) (England) Regulations 2001[4] are revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations, which apply in relation to England, authorise the Secretary of State to make grants to institutions providing various courses or placements to facilitate and encourage the training of a person as a teacher. Such grants may only be paid in respect of expenditure incurred by the institutions in providing bursaries to such a person undertaking, or proposing to undertake, such courses or placements. The payment of grant is dependent on any further conditions imposed by the Secretary of State.

These Regulations also revoke the Education (Teacher Training Bursaries) (England) Regulations 2001 (S.I. 2001/2622).

[1] 1986 c.61; section 50 was amended by section 278(6) of, and paragraph 102 of Schedule 19 to, the Education Act 1993 (c.35) (which continue in force by virtue of paragraph 65 of Schedule 37 to the Education Act 1996 (c.56)) and section 13 of the Education Act 1994 (c.30), and section 63(3) was amended by paragraph 107(a) of Schedule 19 to the Education Act 1993. The Secretary of State can exercise the power under section 50 only in relation to England: see article 2 of and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672).back
