PUBLIC PASSENGER TRANSPORT

London Service Permits (Appeals) Regulations 2002

  Made 10th March 2002 
  Laid before Parliament 11th March 2002 
  Coming into force 1st April 2002 

The Secretary of State for Transport, Local Government and the Regions, in exercise of the powers conferred upon him by section 189(5) of the Greater London Authority Act 1999[1] hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the London Service Permits (Appeals) Regulations 2002 and shall come into force on 1st April 2002.

Interpretation
    
2. In these Regulations - 

Making of appeal
    
3.  - (1) An appeal shall be made by serving notice of appeal in writing on the Panel.

    (2) The notice of appeal shall be signed and dated by or on behalf of the appellant and shall state:

    (3) At the same time as the appellant serves notice of appeal on the Panel he shall send a copy to Transport for London.

Service of documents
    
4.  - (1) The notice of appeal and the copy of that notice, may be served by being - 

    (2) For the purposes of paragraph (1) the proper address of the Panel or Transport for London is -

EXPLANATORY NOTE

(This note is not part of the Regulations)


The Greater London Authority Act 1999 prohibits any person from operating a London local service, where that service will not be part of the London bus network, unless they have been granted a London service permit by Transport for London. Section 189 of the Act provides for an Appeal Panel to determine appeals brought by applicants for permits who have had their applications refused or granted subject to conditions or who have had a permit revoked or suspended. These Regulations prescribe the procedure for making an appeal.
