ATOMIC ENERGY AND RADIOACTIVE SUBSTANCES

The Radioactive Material (Road Transport) (Definition of Radioactive Material) Order 2002

The Secretary of State for Transport, Local Government and the Regions, in exercise of his power under section 1(1)(b) of the Radioactive Material (Road Transport) Act 1991[1], hereby makes the following Order: - 

Citation and Commencement
     1. This Order may be cited as the Radioactive Material (Road Transport) (Definition of Radioactive Material) Order 2002 and shall come into force on 7th June 2002.

Specific activity - definition of radioactive material
    
2. 0.1 kilobecquerels per kilogram is specified as the specific activity for the purposes of section 1(1) of the Radioactive Material (Road Transport) Act 1991 (definition of "radioactive material").

EXPLANATORY NOTE

(This note is not part of the Order)


Section 1(1)(b) of the Radioactive Material (Road Transport) Act 1991 provides that, in that Act, "radioactive material" means any material having a specific activity in excess of 70 kilobecquerels per kilogram or such lesser specific activity as is specified in an Order. This Order specifies the level of activity at 0.1 kilobecquerels per kilogram, thus lowering it from 70 kilobecquerels per kilogram and widening the definition of "radioactive material" for the purposes of that Act.

A Regulatory Impact Assessment has been prepared for this Order and the associated Regulations (The Radioactive Material (Road Transport) Regulations 2002). Copies can be obtained from the Department for Transport, Local Government and the Regions, Radioactive Material Transport Division, 76 Marsham Street, London SW1P 4DR (telephone 020-7944 5768). Copies have been placed in the libraries of each House of Parliament.
