CONSUMER PROTECTION

The Dangerous Substances and Preparations (Safety) (Consolidation) (Amendment) Regulations 2002

The Secretary of State, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to matters relating to consumer protection, in exercise of the powers conferred on her by section 2(2) of that Act, hereby makes the following Regulations: - 

Title and commencement
     1.  - (1) These Regulations may be cited as the Dangerous Substances and Preparations (Safety) (Consolidation) (Amendment) Regulations 2002 and shall come into force on 1st August 2002.

    (2) Regulation 2 below shall have effect notwithstanding the provisions of section 11(5) of the Consumer Protection Act 1987[
3].

Amendments to the Dangerous Substances and Preparations (Safety) (Consolidation) Regulations 1994
     2. The Dangerous Substances and Preparations (Safety) (Consolidation) Regulations 1994[4] are amended by omitting paragraphs (5) and (6) from regulation 3A.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Dangerous Substances and Preparations (Safety) (Consolidation) Regulations 1994 (the principal Regulations) as amended by the Dangerous Substances and Preparations (Safety) (Consolidation) (Amendment) Regulations 1996, the Dangerous Substances and Preparations (Safety) (Consolidation) (Amendment) Regulations 1999, and the Dangerous Substances and Preparations (Safety) (Consolidation) and Chemicals (Hazard Information and Packaging for Supply) (Amendment) Regulations 2000.

These Regulations amend the principal Regulations by removing the derogation at regulation 3A(5) relating to paraffin to which a colouring agent has been added solely to distinguish it for safety reasons from another liquid substance or preparation, which is intended for any use other than as a fuel in decorative lamps.

The prohibition on the supply of certain dangerous substances and preparations that contain a colouring agent and or perfume, which can be used as fuel in decorative lamps is a requirement of Commission Directive 97/64/EEC (OJ No. L 315,19.11.97, p.13) which adapted to technical progress for the fourth time Annex 1 to Council Directive 76/769/EEC (OJ No. L 262, 27.9.76, p.201).
