PUBLIC PASSENGER TRANSPORT

The Minibus and Other Section 19 Permit Buses (Amendment) Regulations 2002

  Made 6th October 2002 
  Laid before Parliament 10th October 2002 
  Coming into force 1st November 2002 

The Secretary of State for Transport, in exercise of the powers conferred by sections 52(1) and 60(1)(e) and (1A) of the Public Passenger Vehicles Act 1981[1], and after consultation with representative organisations in accordance with section 61(2) of that Act, hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Minibus and Other Section 19 Permit Buses (Amendment) Regulations 2002 and shall come into force on 1st November 2002.

Amendment of fees payable for a permit
    
2.  - (1) The Minibus and Other Section 19 Permit Buses Regulations 1987[2] shall be amended in accordance with paragraphs (2) and (3) below.

    (2) In regulation 4(a), for a "£14" there shall be substituted "£15".

    (3) In regulation 4(b), for "£7" there shall be substituted "£8".

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations increase the fee for a permit granted under section 19 of the Transport Act 1985 in respect of the use of a large bus from £14 to £15 and in respect of the use of a small bus from £7 to £8.

The Regulations have been made in conjunction with the Public Services Vehicles (Operators' Licences) (Fees) (Amendment) Regulations 2002, the Community Bus (Amendment) Regulations 2002 and the Public Service Vehicles (Registration of Local Services) (Amendment) (No. 2) (England and Wales) Regulations 2002. A combined Regulatory Impact Assessment for these instruments has been prepared and copies can be obtained from the Buses and Taxis Division of the Department for Transport, Zone 3/13 Great Minster House, 76 Marsham Street, London SW1P 4DR (telephone number 020 7944 2275) or viewed on the Department for Transport website www.dft.gov.uk. A copy has been placed in the libary of both Houses of Parliament.

[1] 1981 c. 14 (the "1981 Act"). Section 52(1) was amended by the Transport Act 1985 (c. 67, "the 1985 Act"), Schedule 2, Part II, paragraph 4(14) and by the Deregulation and Contracting Out Act 1994 (c. 40, "the 1994 Act"), section 66. In section 60, subsection (1) was amended and subsection (1A) inserted by the 1985 Act, section 134, and subsection (1)(e) was substituted by the 1994 Act, section 66(5). Section 61(2) was amended by the 1985 Act, Schedule 8. Section 52 was applied to fees for permits under section 19 of the 1985 Act by section 126(1) of the 1985 Act and sections 60 and 61 have effect by virtue of sections 134 and 135 of the 1985 Act as if Part I of the 1985 Act (including section 19) was incorporated in the 1981 Act. For the definition of "prescribed" see section 60(2) of the 1981 Act.back
