CONSUMER PROTECTION

The Dangerous Substances and Preparations (Safety) (Consolidation) (Amendment No. 3) Regulations 2002

  Coming into force 18th January 2003 

Whereas the Secretary of State has, in accordance with section 11(5) of the Consumer Protection Act 1987[1], consulted such organisations as appear to her to be representative of interests substantially affected by these Regulations, such other persons as she considers appropriate and the Health and Safety Commission;

     Now, therefore, the Secretary of State, in exercise of the powers conferred on her by section 11 of the said Act, hereby makes the following Regulations - 

     1. These Regulations may be cited as the Dangerous Substances and Preparations (Safety) (Consolidation) (Amendment No. 3) Regulations 2002 and shall come into force on 18th January 2003.

    
2. The Dangerous Substances and Preparations (Safety) (Consolidation) (Amendment No. 2) Regulations 2002[2] are hereby revoked.

     3. Schedule 2 to the Dangerous Substances and Preparations (Safety) (Consolidation) Regulations 1994[3] is hereby amended as follows -

EXPLANATORY NOTE

(This note is not part of the Regulations)


The Dangerous Substances and Preparations (Safety) (Consolidation) (Amendment No. 2) Regulations 2002 (S.I. 2002/2479; "the 2002 Regulations") sought to implement European Parliament and Council Directive 2001/41/EC (O.J. No. L194, 18.07.01, p.36). That Directive amended for the 21st time Council Directive 76/769/EEC (O.J. No. L262, 27.9.76, p.201) on the approximation of the laws, regulations and administrative provisions of the Member States relating to the restrictions on the marketing and use of certain dangerous substances and preparations.

These Regulations, which amend the Dangerous Substances and Preparations (Safety) (Consolidation) Regulations 1994 (S.I. 1994/2844; "the Principal Regulations"), revoke and re-enact the 2002 Regulations. These Regulations correct the 2002 Regulations by substituting corrected category headings for the category headings cited in the 2002 Regulations. In addition, entries appropriate to the corrected category headings are specified in these Regulations.

The Principal Regulations prohibit the supply to the general public of the substances listed in Schedule 2 to those Regulations. A substance specified in Schedule 2 or a preparation containing such a substance is required to be classified and labelled in accordance with regulation 8(4) of the Chemicals (Hazard Information and Packaging for Supply) Regulations 2002 (S.I. 2002/1689). The list of substances is derived from the Annex to Directive 76/769/EEC. It is a list of carcinogenic and mutagenic substances and certain substances toxic to reproduction. These Regulations update the list to include the amendments made by Directive 2001/41/EC.
