The Secretary of State for Health, in exercise of the powers conferred on him by sections 64(6) and 70(10) of the Health and Social Care Act 2001[1], hereby makes the following Order:
Citation and commencement
1.
This Order may be cited as the Health and Social Care Act 2001 (Isles of Scilly) Order 2003 and shall come into force on 8th February 2003.
Application of the Health and Social Care Act 2001 to the Isles of Scilly

- (1) The provisions of the Health and Social Care Act 2001 specified in paragraph (2) shall extend to the Isles of Scilly with the modification that, in the application of those provisions to those Isles, any reference to a local authority is to be construed as a reference to the Council of the Isles of Scilly[2].
(2) The provisions referred to in paragraph (1) are -
(a) Part 1 (national health service), apart from sections 7 to 10 (local authority scrutiny of health service provision) and Schedule 1 (exempt information relating to health services);
(b) Part 2 (pharmaceutical services), apart from section 44 (dispensing of NHS prescriptions);
(c) Part 3 (care trusts and partnership arrangements); and
(d) Part 1 of Schedule 5 (minor and consequential amendments) and Parts 1 and 2 of Schedule 6 (repeals) and, insofar as it relates to those Parts, section 67.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order extends to the Isles of Scilly as from 8th February 2003 those provisions of the Health and Social Care Act 2001 which are concerned with the National Health Service, pharmaceutical services and Care Trusts and partnership arrangements, apart from sections 7 to 10 and Schedule 1 (which are concerned with local authority scrutiny of health service provision) and section 44 (which is concerned with Scotland). The Order includes an appropriate modification of the references to a local authority.
