The Child Benefit and Guardian's Allowance (Transfer of Staff) (Northern Ireland) Order 2003

Her Majesty, in exercise of the powers conferred upon Her by section 52(7) of the Tax Credits Act 2002[1] is pleased, by and with the advice of Her Privy Council to order, and it is hereby ordered, as follows: - 

Citation and commencement
     1. This Order may be cited as the Child Benefit and Guardian's Allowance (Transfer of Staff) (Northern Ireland) Order 2003 and shall come into force on 1st April 2003.

Interpretation
    
2. In this Order "the Department" means the Department for Social Development in Northern Ireland and "the Child Benefit Office" means the Child Benefit Office of the executive Agency known as the Social Security Agency, within the Department.

Transfer of staff
    
3.  - (1) With effect from 1st April 2003 there shall be transferred to Her Majesty's Home Civil Service the persons specified in paragraph (2).

    (2) The persons specified are those persons employed wholly in the Child Benefit Office, not above the grade of deputy principal.

    (3) Where a person is transferred to Her Majesty's Home Civil Service under this Article, his period of employment in the Northern Ireland Civil Service shall count as a period of continuous employment in Her Majesty's Home Civil Service for the purposes of the Employment Rights (Northern Ireland) Order 1996[2].

EXPLANATORY NOTE

(This note is not part of the Order)


This Order transfers from the Department for Social Development in Northern Ireland ("the Department") to the Inland Revenue the staff of the Child Benefit Office of the Social Security Agency, an executive Agency of the Department. This is in consequence of the transfer under Part 2 of the Tax Credits Act 2002 (c. 21) of functions relating to child benefit and guardian's allowance on 1st April 2003.
