ROAD TRAFFIC

The International Carriage of Dangerous Goods by Road (Fees) (Amendment) Regulations 2003

  Coming into force 11th August 2003 

The Secretary of State for Transport, with the consent of the Treasury, in exercise of the powers conferred by section 56(1) and (2) of the Finance Act 1973[1] and the Department of Transport (Fees) Order 1988[2], and in exercise of all other powers enabling him in that behalf, hereby makes the following Regulations: - 

Citation and commencement
     1. These Regulations may be cited as the International Carriage of Dangerous Goods by Road (Fees) (Amendment) Regulations 2003 and shall come into force on 11th August 2003.

Increases in fees
    
2.  - (1) The International Carriage of Dangerous Goods by Road (Fees) Regulations 1988[3] shall be amended as follows.

    (2) In the regulations specified in column (1) of the Table below for the amounts specified in column (2) substitute the amounts specified in column (3).

Amendment of regulation 8(3) (cancellation of appointments)
     3. In regulation 8(3), for "the fee payable by him in respect of the application for the ADR certificate shall be £2.50 and the balance of any sum tendered under regulation 7 shall be returned" substitute "any sum paid by him in respect of the application for the ADR certificate shall be returned".

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the International Carriage of Dangerous Goods by Road (Fees) Regulations 1988 ("the 1988 Regulations").

Regulation 2 makes the following amendments to the fees prescribed by the 1988 Regulations. An "ADR certificate" is a special certificate of approval as defined in regulation 2 of the 1988 Regulations. "ADR" is the acronym for "Accord European Relatif au Transports International des Marchandises Dangereuses par Route".

Regulation 3 amends regulation 8(3) of the 1988 Regulations by providing for the return to the applicant of any sum paid by him in respect of an application for an ADR certificate where he does not make an application for another inspection in accordance with regulation 8(2) of the 1988 Regulations.

A regulatory impact assessment has been prepared and copies can be obtained from the Department for Transport, Zone 2/05, Great Minster House, 76 Marsham Street, London SW1P 4DR (telephone number: 020-7944 2455). A copy has been placed in the library of each House of Parliament.
