ENVIRONMENTAL PROTECTION, ENGLAND AND WALES

The Financial Assistance for Environmental Purposes (England and Wales) Order 2003

  Made 12th August 2003 
  Laid before Parliament 14th August 2003 
  Coming into force 10th September 2003 

The Secretary of State, in exercise of the powers conferred upon her by section 153(4) of the Environmental Protection Act 1990[1], hereby makes the following Order:

Title, extent and commencement
     1. This Order  - 

Variation of section 153(1) of the Environmental Protection Act 1990
    
2. In section 153(1) of the Environmental Protection Act 1990[2] (purposes for which financial assistance may be given), after paragraph (tt)[3], there shall be inserted the following paragraph -

EXPLANATORY NOTE

(This note is not part of the Order)


This Order varies section 153(1) of the Environmental Protection Act 1990, adding the UK Environment for Europe Fund to the list of organisations etc. in that section to which the Secretary of State may, with the consent of the Treasury, give financial assistance for environmental purposes.

The purpose of the UK Environment for Europe Fund is to promote environmental protection and sustainable development in Central and Eastern Europe, the Caucasus and Central Asia. Details of the Fund are available on the Department for Environment, Food and Rural Affairs' website at

Notes:

[1] 1990 c. 43. The relevant functions of the Secretary of State, insofar as they relate to Scotland, were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). In relation to Wales, whilst the Secretary of State retains the power to act under section 153 of the Environmental Protection Act 1990, save insofar as her functions under that section conduce to the protection, improvement or better understanding of the environment of, or any part of, Wales, in which case those functions are to be exercised concurrently with the National Assembly for Wales (see article 2 of, and the entry relating to the Environmental Protection Act 1990 in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672)), the UK Environment for Europe Fund does not support any activities in Wales (or any other part of the United Kingdom). This Order enables assistance to the Fund to be given under the laws of England and Wales.back
