SOCIAL SECURITY

The State Pension Credit (Transitional and Miscellaneous Provisions) Amendment Regulations 2003

The Secretary of State in exercise of the powers conferred by the sections 5(1)(h), (hh) and (3A), 189(1), (4)(a) and (6), and 191 of the Social Security Administration Act 1992[1], sections 10(3) and (6), 79(1) and 84 of the Social Security Act 1998[2], section 115(3) and (4) of the Immigration and Asylum Act 1999[3] and sections 1(5)(b), 2(6), 12(2) and (3), 13(1), 15(1)(e) and (j), 15(2), (6)(b) and (d), 17(1) and (2)(a) of the State Pension Credit Act 2002[4] and of all other powers enabling him in that behalf, and after agreement by the Social Security Advisory Committee that proposals in respect of these Regulations should not be referred to it[5], hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the State Pension Credit (Transitional and Miscellaneous Provisions) Amendment Regulations 2003 and shall come into force on 6th October 2003 immediately after the coming into force of the State Pension Credit (Consequential, Transitional and Miscellaneous Provisions) (No.2) Regulations 2002[6].

Amendment of the State Pension Credit Regulations 2002
     2.  - (1) The State Pension Credit Regulations 2002[7] shall be amended in accordance with the following paragraphs.

    (2) In regulation 1(2) (definitions) at the appropriate place in the alphabetical order insert - 

    (3) In regulation 2 (persons not in Great Britain) after paragraph (d) add - 

    (4) In regulation 3(1)(persons temporarily absent from Great Britain) for "person's", substitute "claimant's".

    (5) In regulation 5 (persons treated as being or not being members of the same household) - 

    (6) In regulation 10(1)(assessed income period) after sub-paragraph (b) add - 

    (7) In regulation 15(5)(prescribed income for the purposes of section 15 of the Act) - 

    (8) In Schedule I (circumstances in which persons are treated as being severely disabled), in - 

for the words "invalid care allowance" substitute "carer's allowance".

    (9) In Schedule II (Housing Costs) - 

    (10) In Schedule III (Special Groups) in paragraph 1(8) for "6(5)(b)(iv)" substitute "6(5)(b)(v)".

    (11) In Schedule IV (amounts to be disregarded in the calculation of income other than earnings) - 

    (12) In Schedule V, Part I (capital disregarded for the purposes of calculating income) - 

    (13) In Schedule VI (sums disregarded from claimant's earnings) after paragraph 2A[29] add -

     3. In regulation 36 of the State Pension Credit (Consequential, Transitional and Miscellaneous Provisions) Regulations 2002[30] (persons entitled to income support immediately before the appointed day) - 

Amendment of the Social Security (Claims and Payments) Regulations 1987
     4. In regulation 32 of the Social Security (Claims and Payments) Regulations 1987[32] (information to be given and changes to be notified) - 

Amendment of the Social Security and Child Support (Decisions and Appeals) Regulations 1999
     5.  - (1) The Social Security and Child Support (Decisions and Appeals) Regulations 1999[34] shall be amended in accordance with the following paragraphs.

    (2) In regulation 6(2) (supersession of decisions) after sub-paragraph (l)[35] add - 

    (3) In regulation 7 (date from which a decision under section 10 takes effect) - 

    (4) In Schedule 3B[37] (date on which change of circumstances takes effect where claimant entitled to state pension credit) for paragraph 5 substitute - 

Amendment of the Social Security (Immigration and Asylum) Consequential Amendments Regulations 2000
     6.  - (1) Regulation 2 of the Social Security (Immigration and Asylum) Consequential Amendments Regulations 2000[38] shall be amended in accordance with the following paragraphs.

    (2) In paragraph (1) (persons not excluded from specified benefits under section 115 of the Immigration and Asylum Act 1999) after "Contributions and Benefits Act," there shall be inserted the words "or state pension credit under the State Pension Credit Act 2002[39],".

    (3) After paragraph (4)(b) insert -

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Social Security (Claims and Payments) Regulations 1987 ("the Claims and Payments Regulations"), the Social Security and Child Support (Decisions and Appeals) Regulations 1999 ("the Decisions and Appeals Regulations"), the State Pension Credit Regulations 2002 and the State Pension Credit (Consequential, Transitional and Miscellaneous Provisions) Regulations 2002 in connection with the introduction of state pension credit on 6th October 2003.

Regulation 2 amends the State Pension Credit Regulations 2002. In particular it - 

Regulation 3 clarifies regulation 36(7) of the State Pension Credit (Consequential, Transitional and Miscellaneous Provisions) Regulations 2002 as an exception to the Decisions and Appeals Regulations.

Regulation 4 amends regulation 32(6) of the Claims and Payments Regulations so as to extend the category of cases to which sub-paragraph (b) applies and inserting sub-paragraph (c).

Regulation 5 amends the Decisions and Appeals Regulations so as to provide a new ground for supersession in relation to state pension credit and new dates on which certain state pension credit decisions take effect.

Regulation 6 amends provisions concerning the circumstances in which certain persons who are subject to immigration control are eligible to be awarded state pension credit.

These Regulations do not impose a charge on business.
