DANGEROUS DRUGS

The Misuse of Drugs (Amendment) (No. 3)Regulations 2003

  Laid before Parliament 23rd September 2003 
  Coming into force 15th October 2003 

In pursuance of sections 7(1)(b), 10, 22 and 31(1) of the Misuse of Drugs Act 1971[1], after consultation with the Advisory Council on the Misuse of Drugs, the Secretary of State hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Misuse of Drugs (Amendment) (No. 3) Regulations 2003 and shall come into force on 15th October 2003.

Amendment of the Misuse of Drugs Regulations 2001
    
2.  - (1) The Misuse of Drugs Regulations 2001[2] shall be amended as follows.

    (2) In regulation 2(1) there shall be inserted - 

    (3) In regulation 6 there shall be inserted - 

    (4) In regulation 7 there shall be inserted after paragraph (3) - 

    (5) In regulation 8 there shall be inserted after paragraph (6) - 

    (6) In regulation 9 there shall be inserted after paragraph (6) - 

    (7) In regulation 10 there shall be inserted - 

    (8) After Schedule 7 the Schedule to these Regulations shall be inserted.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Misuse of Drugs Regulations 2001 ("the 2001 Regulations"). Regulations 2(3), 2(4), 2(5), 2(6) and 2(7) amend regulations 6, 7, 8, 9 and 10 to allow extended formulary nurse prescribers, registered nurses and persons authorised under patient group directions to prescribe, supply, possess and administer specified controlled drugs in certain circumstances only. The Schedule to these Regulations, inserts a new Schedule 8, into the 2001 Regulations which details the persons who may supply or administer specified controlled drugs under a patient group direction. Regulation 2(2) inserts further definitions into the 2001 Regulations which are consequential upon the amendments made.
