POLICE

The Regulation of Investigatory Powers (Foreign Surveillance Operations) Order 2004

  Made 13th April 2004 
  Laid before Parliament 16th April 2004 
  Coming into force 7th May 2004 

In exercise of the powers conferred upon him by section 76A(8) of the Regulation of Investigatory Powers Act 2000[1], the Secretary of State hereby makes the following Order:

     1. This Order may be cited as the Regulation of Investigatory Powers (Foreign Surveillance Operations) Order 2004 and shall come into force on 7th May 2004.

     2. The Director General of the National Criminal Intelligence Service[2] is hereby designated for the purposes of section 76A(8) of the Regulation of Investigatory Powers Act 2000.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order designates the Director General of the National Criminal Intelligence Service for the purposes of section 76A(8) of the Regulation of Investigatory Powers Act 2000 ("the Act") . Under section 76A of the Act foreign police or customs officers may, under certain conditions, lawfully carry out surveillance in the United Kingdom. This Order enables the Director General to notify foreign police or customs officers carrying out surveillance in the United Kingdom that the surveillance will cease being lawful upon the giving of the notification.
