IMMIGRATION

The Travel Documents (Fees) (Amendment) Regulations 2005

  Made 10th March 2005 
  Laid before Parliament 10th March 2005 
  Coming into force 1st April 2005 

The Secretary of State, in exercise of the powers conferred upon him by sections 27(1) and 166(3) of the Immigration and Asylum Act 1999[1] and section 56(1) of the Finance Act 1973[2], and with the approval of the Treasury, hereby makes the following Regulations:

     1. These Regulations may be cited as the Travel Documents (Fees) (Amendment) Regulations 2005 and shall come into force on 1st April 2005.

    
2. For regulation 3(1) and (2) of the Travel Documents (Fees) Regulations 1999[3] there shall be substituted:

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Travel Documents (Fees) Regulations 1999 ("the 1999 Regulations").

Previously, children under the age of sixteen were not required to make a separate application for a travel document; they could be named on the travel document issued to the adult with whom they were to travel. From 1st April 2005, however, children under the age of sixteen will be required to make a separate application for a travel document.

These Regulations amend the 1999 Regulations to specify the fees which must be paid when an application for a travel document is made in respect of a child who is under the age of sixteen. Where the application is for a Convention travel document or a document of identity, the fee to be paid is £25. Where the application is for any other Home Office travel document, the fee to be paid is £115.

These Regulations also amend the 1999 Regulations to increase the fee for a Home Office travel document other than a Convention travel document or a document of identity, in all cases where the application is in respect of a person who is sixteen or over, from £67 to £195. This is to recover the full administrative cost of processing applications.

Convention travel documents are issued in accordance with either Article 28 of the Convention relating to the Status of Refugees adopted on 28th July 1951 or Article 28 of the Convention relating to the Status of Stateless Persons adopted on 28th September 1954. Documents of identity are issued at the discretion of the Secretary of State to any foreign national in the United Kingdom and enable the holder to make one journey out of the United Kingdom.
