The Rail Vehicle Accessibility (Heathrow Express Class 360/2) Exemption (Amendment) Order 2005

  Made 25th May 2005 
  Laid before Parliament 1st June 2005 
  Coming into force 27th June 2005 

The Secretary of State, in exercise of the powers conferred upon him by section 47(1), (3) and (4) of the Disability Discrimination Act 1995[1], having consulted the Disabled Persons Transport Advisory Committee and such other persons as he considered appropriate, hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Rail Vehicle Accessibility (Heathrow Express Class 360/2) Exemption (Amendment) Order 2005 and shall come into force on 27th June 2005.

Amendment
    
2.  - (1) The Rail Vehicle Accessibility (Heathrow Express Class 360/2) Exemption Order 2005[2] is amended as follows.

    (2) In article 2, for sub-paragraph (a) there shall be substituted -

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the Rail Vehicle Accessibility (Heathrow Express Class 360/2) Exemption Order 2005 (S.I. 2005/86) which authorises the use of specified rail vehicles even though they do not conform with the Rail Vehicle Accessibility Regulations 1998 (S.I. 1998/2456, amended by S.I. 2001/3215). The Order authorises the use of additional vehicles in the Class 360/2 fleet of electric multiple-units because the carpets in the vestibule do not contrast sufficiently with the carpets in the adjacent passenger saloon.

A full regulatory impact assessment has not been produced for the instrument as it has no impact on the costs of business.
