ROAD TRAFFIC

The Road Vehicles (Construction and Use) (Amendment) Regulations 2005

  Made 18th June 2005 
  Laid before Parliament 23rd June 2005 
  Coming into force 1st August 2005 

The Secretary of State for Transport, in exercise of the powers conferred by section 41(1), (2) and (5) of the Road Traffic Act 1988[1], and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Road Vehicles (Construction and Use) (Amendment) Regulations 2005 and shall come into force on 1st August 2005.

Amendment of the Road Vehicles (Construction and Use) Regulations 1986
    
2. —(1) Schedule 7B to the Road Vehicles (Construction and Use) Regulations 1986[2] shall be further amended as follows.

    (2) In paragraph 7, for sub-paragraph (b) there shall be substituted the following sub-paragraph—

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations further amend the Road Vehicles (Construction and Use) Regulations 1986 ("the 1986 Regulations").

Regulation 2 amends the definition of "the emissions publication" in Schedule 7B of the 1986 Regulations so as to refer to the most recent (i.e. the eleventh) edition of the publication entitled "In Service Exhaust Emission Standards for Road Vehicles". The publication contains in-use emissions limits that petrol-engined cars and light vans are required to meet at MoT and Roadside emissions tests. The publication updates new models of petrol-engined passenger cars and light commercial vehicles, which have come onto the market since the last amending regulations came into effect on 1st August 2004, and also revises a small amount of data on existing models.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
