EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Naval, Military and Air Forces Etc. (Disablement and Death) Service Pensions Order 1983 ("the Service Pensions Order") in the manner described below.

The Service Pensions Order sets out the rates of retired pay, pensions, gratuities and allowances in respect of disablement or death due to service in the armed forces. The Table at Part IV of Schedule 1 to that Order details rates of allowance payable in respect of disablement and earnings or income thresholds. The amounts set out in the Service Pensions Order are subject to annual revision.

The Naval, Military and Air Forces Etc. (Disablement and Death) Service Pensions (Amendment) Order 2005 (SI 2005/851) amended the Service Pensions Order, amongst other things, by inserting a revised version of the Table at Part IV of Schedule 1 to that Order. The revised Table contained an error in relation to the figure specified for part time treatment allowances. This Order amends the Service Pensions Order by substituting the correct figure with effect from the date of the earlier revision.

A regulatory impact assessment has not been produced for this instrument as it has no significant impact on the costs of business, charities or voluntary bodies.
