The Fish Labelling (Amendment) (England) Regulations 2006

  Made 27th February 2006 
  Laid before Parliament 9th March 2006 
  Coming into force 6th April 2006 

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 16(1)(e) and (f), 17(2), 26(3) and 48(1) of the Food Safety Act 1990 [1] and now vested in her[2].

     In accordance with section 48(4A) of that Act, she has had regard to relevant advice given by the Food Standards Agency.

     As required by Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety[3] there has been open and transparent public consultation during the preparation and evaluation of these Regulations.

Title, commencement and application
     1. These Regulations may be cited as the Fish Labelling (Amendment) (England) Regulations 2006, shall come into force on 6th April 2006 and shall apply in relation to England only.

EXPLANATORY NOTE

(This note is not part of the Regulations)


     1. These Regulations, which apply to England only, amend the Fish Labelling (England) Regulations 2003 ("the principal Regulations") which provide for the execution and enforcement of Title 1, Chapter 2 of Council Regulation (EC) No. 104/2000 on the common organisation of the markets in fishery and aquaculture products as applied by Commission Regulation (EC) No. 2065/2001 laying down detailed rules on the application of Council Regulation (EC) No. 104/2000 as regards informing consumers about fishery and aquaculture products.

     3. A Regulatory Impact Assessment has been prepared and placed in the Library of each House of Parliament. Copies may be obtained from the Consumer Choice, Food Standards and Special Projects Division of the Food Standards Agency, Aviation House, 125 Kingsway, London WC2B 6NH.

[2] Functions formerly exercisable by "the Ministers" are now exercisable in relation to England by the Secretary of State pursuant to paragraph 8 of Schedule 5 to the Food Standards Act 1999 (1999 c. 28), and paragraphs 12 and 21 of that Schedule amend sections 17 and 48 of the 1990 Act. Section 48 was also amended by S.I. 2004/2990. Functions of "the Ministers" so far as exercisable in relation to Wales were transferred to the National Assembly for Wales by S.I. 1999/672 and those functions so far as exercisable in relation to Scotland were transferred to the Scottish Ministers by section 53 of the Scotland Act 1998 (1998 c. 46). Section 26(3) of the 1990 Act was amended by section 40(4) of, and Schedule 6 to, the Food Standards Act 1999.back
