INTERNATIONAL IMMUNITIES AND PRIVILEGES

The International Organisations (Immunities and Privileges) Miscellaneous Provisions Order 2006

  Made 11th April 2006 
  Coming into force 12th April 2006 

At the Court at Windsor Castle, the 11th day of April 2006

The Queen's Most Excellent Majesty in Council

In accordance with section 10 of the International Organisations Act 1968 ("the Act")[1] a draft of this Order was laid before Parliament and approved by a resolution of each House of Parliament:

     Now, therefore, Her Majesty, in exercise of the powers conferred on Her by sections 1(7)[2] and 10(3) of the Act, is pleased, by and with the advice of Her Privy Council, to order, and it is ordered, as follows—

     1. This Order may be cited as the International Organisations (Immunities and Privileges) Miscellaneous Provisions Order 2006 and shall come into force on the day after the day on which it is made.

    
2. The Orders set out in the Schedule to this Order shall have effect subject to the amendments specified in that Schedule.

Article 2

Order Amendment
The Customs Co-operation Council (Immunities and Privileges) Order 1974[3] In Article 15(3), for "his spouse" substitute "his spouse or civil partner".
The European Court of Human Rights (Immunities and Privileges) (Amendment) Order 2000[4] In Article 4A(1), for "spouses" substitute "spouses or civil partners".
The International Atomic Energy Agency (Immunities and Privileges) Order 1974[5] In Article 15(3), for "his spouse" substitute "his spouse or civil partner".
The International Seabed Authority (Immunities and Privileges) Order 2000[6] In Article 17(3), for "his spouse" substitute "his spouse or civil partner".
The Organisation for Economic Co-operation and Development (Immunities and Privileges) Order 1974[7] In Article 15(3), for "his spouse" substitute "his spouse or civil partner".
The Organisation for the Prohibition of Chemical Weapons (Immunities and Privileges) Order 2001[8] In Article 14(1), for "his spouse" substitute "his spouse or civil partner".
The Preparatory Commission for the Comprehensive Nuclear-Test-Ban Treaty Organization (Immunities and Privileges) Order 2004[9] In Article 15(2), for "his spouse" substitute "his spouse or civil partner".
The Specialised Agencies of the United Nations (Immunities and Privileges) Order 1974[10]

The United Nations and International Court of Justice (Immunities and Privileges) Order 1974[11]

In Article 15(3), for "his spouse" substitute "his spouse or civil partner".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order makes amendments to the Orders set out in the Schedule consequent upon the coming into force of the Civil Partnership Act 2004. The Order confers privileges and immunities on civil partners to the same extent, and in the same circumstances, as such privileges and immunities have been conferred on spouses of individuals specified in the Orders set out in the Schedule.
